Please read these Terms of Service ("Terms") carefully before using the Curbi mobile application operated by Curbi LLC ("Curbi," "we," "us," or "our"). By creating an account or using Curbi, you agree to be bound by these Terms.
1. About Curbi
Curbi is a peer-to-peer marketplace platform that connects property owners who have parking spaces ("Hosts") with individuals seeking parking ("Drivers"). Curbi does not own, operate, manage, or control any parking spaces listed on the platform. We provide technology to facilitate transactions between Hosts and Drivers.
Curbi is not a parking operator, property manager, or transportation company. We are not a party to any agreement between a Host and a Driver for the use of a parking space.
2. Eligibility
You must be at least 18 years of age to create an account or use Curbi. By using Curbi, you represent and warrant that:
- You are at least 18 years old.
- You have the legal authority to enter into these Terms.
- You will use Curbi only for lawful purposes and in compliance with these Terms.
- All information you provide to Curbi is accurate, current, and complete.
3. Accounts
You must register for an account to use Curbi. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@curbi.us if you suspect unauthorized use of your account.
You may register as a Driver, a Host, or both. You may switch between modes within the app at any time.
4. Booking and Cancellation Policy
Making a Booking
Drivers may request to book an available parking space for specified dates. A booking is confirmed once the Driver's payment is processed. Hosts are notified of each new booking request.
Cancellations by Drivers
- Cancellations made more than 48 hours before the booking start date may be eligible for a full refund, at the Host's discretion as set in their listing.
- Cancellations made within 48 hours of the booking start date may not be eligible for a refund.
- Specific cancellation terms may vary by listing. Review the listing's cancellation policy before booking.
Cancellations by Hosts
Hosts who cancel confirmed bookings may be subject to penalties including reduced search ranking. Drivers will receive a full refund for any Host-initiated cancellation.
No-Shows
If a Driver fails to use a booked space without cancelling in advance, no refund will be issued.
5. Payment Terms
All payments are processed securely through Stripe. Curbi charges the following fees:
- Driver Service Fee: 5% of the booking subtotal, charged to the Driver at the time of booking.
- Host Service Fee: 10% of the booking subtotal, deducted from the Host's payout.
For example, on a $100 booking: the Driver pays $105 total; the Host receives $90; and Curbi retains $15 as its service fee.
Host payouts are processed through Stripe Connect and are subject to Stripe's standard payout schedule (typically 2–7 business days). Hosts must complete Stripe Connect onboarding before receiving payouts. All prices are displayed and charged in U.S. dollars.
6. Property Damage Policy
Curbi is not responsible for any property damage, theft, vandalism, or loss that occurs on or in connection with a listed parking space. Hosts and Drivers are solely responsible for any damage claims between them.
We encourage Hosts to document the condition of their property before and after each booking. Any disputes regarding property damage should be resolved directly between the Host and Driver. Curbi may, at its sole discretion, assist with dispute resolution but is under no obligation to do so.
Curbi strongly recommends that all Hosts maintain adequate homeowner's or renter's insurance that covers commercial activities on their property.
7. User Conduct
You agree not to:
- List a parking space that you do not have the right to rent.
- Misrepresent the location, condition, or availability of a parking space.
- Use Curbi for any unlawful purpose or in violation of any applicable law or regulation.
- Harass, threaten, or intimidate other users.
- Circumvent Curbi's payment system by arranging off-platform payments.
- Submit false reviews or manipulate ratings.
- Use automated tools, bots, or scrapers to access Curbi's services without permission.
- Post content that is defamatory, obscene, or infringes on third-party rights.
8. Limitation of Liability
Curbi's total liability to you for any claim arising from these Terms or your use of the platform shall not exceed the greater of (a) the total fees paid by you to Curbi in the 12 months preceding the claim, or (b) $100 USD.
9. Indemnification
You agree to indemnify and hold harmless Curbi, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of Curbi, your violation of these Terms, or your violation of any rights of a third party.
10. Account Termination
Curbi reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms.
- Fraudulent, abusive, or illegal activity.
- Repeated negative reviews or complaints from other users.
- Extended periods of inactivity.
You may close your account at any time by contacting us at legal@curbi.us.
11. Intellectual Property
All content on the Curbi platform, including the name, logo, design, and software, is the property of Curbi LLC and is protected by applicable intellectual property laws. You may not copy, modify, or distribute any Curbi content without our prior written consent.
12. Governing Law
These Terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Connecticut.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the app or via email. Continued use of Curbi after changes take effect constitutes your acceptance of the revised Terms.
